Arabic Abstract

لقد عملت هذه الدراسة، و التي هي بعنوان المسؤولية السياسية لمجلس الوزراء في النظام السياسي الفلسطيني على معالجة الخلل الدستوري الذي عانى منه النظام السياسي الفلسطيني في إدارة الحكم و سبل الوصول لتلك الإشكاليات، و تقديم الحلول لها في ظل تطبيق القانون الأساسي الفلسطيني المعدل رقم ( 3 ) لسنة 2003م، و مقارنتها بالأنظمة المعاصرة و بيان حكم الشريعة الإسلامية لتلك الأنظمة و الوسائل المتبعة في تنظيم الحكم في فلسطين.

كما و أن الباحث، و من خلال هذه الدراسة قدم حلول لإشكالية ازدواجية المسؤولية السياسية في النظام السياسي الفلسطيني لمجلس الوزراء، و حتى يتم تقديم الدراسة بشكل متكامل فقد اتبع الباحث المنهج الوصفي التحليلي، و المنهج المقارن من خلال تحليل النصوص القانونية للقانون الأساسي الفلسطيني، و مقارنتها بالأنظمة القانونية المعاصرة و بيان أحكام الشريعة الإسلامية فيها.

لذلك قسم الباحث هذه الدراسة إلى ثلاث فصول، و قد خصص الفصل الأول للحديث عن المسؤولية السياسية، و نطاق تطبيقها، وتطرق الفصل الثاني المسؤولية رئيس الوزراء أمام رئيس السلطة الوطنية الفلسطينية، و تداخل صلاحيات كل منهما في إطار القانون الأساسي و تداخلات الرئيس في أعمال مجلس الوزراء، و في الفصل الثالث تناول الباحث المسؤولية السياسية لمجلس الوزراء أمام المجلس التشريعي، و آليات و وسائل الرقابة التي يمارسها المجلس التشريعي على أعمال مجلس الوزراء، و تداخل أعمال السلطة التشريعية في أعمال المطلة التنفيذية في ظل الأخذ بمبدأ الفصل بين السلطات بطريقة مرنة.

و اختتمت الدراسة بعدد من النتائج و التوصيات، أهمها تعديل النظام السياسي الفلسطيني و تبكي نظام معين من الأنظمة المعاصرة التي تتلاءم مع الحالة الفلسطينية، في ظل تعثر تلك التجرية في الدستور الفلسطيني الحالي، و التي أفضلها كما استنتج الباحث النظام الرئاسي لأنه أقرب نظام من نظام الحكم في الإسلام، و التي تسأله سبحانه و تعالى أن يكون لها دور في معالجة الازدواجية في رئاسة مجلس الوزراء و صلاح الحكم في فلسطين و استقراره و معالجة ذلك من قبل المشرع الفلسطيني.

English Abstract

This study, which is entitled ‘Political Responsibility of the Council of Ministers in the Palestinian Political System’, dealt with the constitutional imbalance that the Palestinian political system experienced in governance and the ways to address these problems and find solutions to them in the light of the application of the Palestinian Amended Basic Law No.

3 of 2003.

The study also compared such solutions to the contemporary systems and stated the provisions of Islamic Shari’a on those systems and the methods used in organizing governance in Palestine.

The researcher also presented solutions to the problem of the Council of Ministers’ duplication of political responsibility in the Palestinian political system.

The researcher used the analytical descriptive method and the comparative method in analyzing the legal texts of the Palestinian Basic Law, comparing them with contemporary legal systems, and outlining the provisions of the Islamic Shari’a.

The researcher divided this study into three chapters.

The first chapter deals with the political responsibility and the scope of its implementation, while the second chapter examines the responsibility of the Prime Minister to the President of the Palestinian National Authority, and the overlap of their respective powers under the Basic Law, and the overlap of the President’s powers with the work of the Council of Ministers.

In the third chapter, the researcher addressed the political responsibility of the Council of Ministers to the Legislative Council and the mechanisms and means of monitoring exercised by the Legislative Council on the work of the Council of Ministers in addition to the overlap between the work of the Legislature and the work of the Executive Authority in light of the principle of separation of powers in a flexible manner.

The researcher concluded this study with a number of conclusions and recommendations, the most important of which relate to the need to amend the Palestinian political system and adopt a certain contemporary system that is compatible with the Palestinian situation, especially in light of the faltering experience of the current Palestinian constitution.

The most suitable system is the presidential system as it is the closest to the systems of governance in Islam.

The researcher hopes that his study plays a role in addressing the duplication in the presidency of the Council of Ministers and the rule of good governance in Palestine and its stability and how this can be addressed by the Palestinian legislators.
