Abstract EN

This research is about the issue of life insurance and its impact on inheritance.

It draws on the definitions of inheritance and life insurance and specifies the place of this kind of insurance among other types.

It also outlines Islamic ruling on this issue and Islamic adjustment of the commercial and cooperative life insurance contract in Shari’a, so as to clarify its effect on inheritance.

Finally, it determines the extent to which the amount of compensation can be dealt with in the same way as inheritance.

This research concluded that dealing with life insurance in the same way as cooperative insurance is a correct contract in Sharia and that the amount of compensation should be dealt with according to the conditions set by the insured, regardless of whether or not the amount is to be paid to the inheritors or to other parties.

As for life insurance which is managed in the way commercial insurance is dealt with, it is an incorrect contract in Shari’a and it does not have any impact whatsoever.

The amount of compensation is considered and then the inheritors are given the installments paid by the insured.

Any extra money is considered ill-gotten (haram) and it must not be given to inheritors.

It has to be given to poor people as a charity.
