Abstract EN

The issue of Neighbors’ obligations is one of the topics of modern civil law.

All civil legislations have been careful to organize the relationship between neighbors and have put regulations through the control of the right to ownership so as to prevent any excessive use of this right that might cause harm to the neighbor.

As we examine Islamic legislation, we find out that the honorable Sunnah both preceded and exceeded positive laws in terms of accuracy and organization of neighborhood relations.

While positive laws have been concerned only with the damage that may be caused by neighbors and how to eliminate them, the honorable Sunnah developed an integrated approach to rid neighbors of harms in case they occur and to encourage neighbors to be courteous to each other.

It also gave the neighbor rights that must be respected by his fellow neighbor and by so doing it outdid positive laws.

This research aims at studying neighbors’ obligations through systematic examination of the Prophetic Sunnah, which is characterized by its coverage and regulation of all life affairs and issues.
