Abstract EN

During the middle era, the world of Maghreb and Andalusia has known the rebirth of small city-states.

These states governed some parts, but they could not take over all the territory until the era of Almohad dynasty.

Many researchers and historians focus in their studies of Almohad on the political, military and social sides.

The issue of the judiciary was not an important part, though, the great role of this side on protecting the stability of the society and the state behind.

There are many definitions of judiciary, but the most common one is that it is judging and giving a legal Islamic decision.

It is also ending struggles between people up to Islamic values in dealing with the issues of the nation.

After that we gave a spotlight on the state by observing that it was not founded during the life of Amahdi, but until the death of Abdelmoumen ben Ali its caliphate.

People depended on alkitab and sunnah as sources of legacy and judging .

Also, the caliphate had the right of explaining anything in addition to the works of Amahdi.

Judiciary played a great role in stating justice among people and assuring rights and duties, and spreading peace in the state and the society.

Moreover, we noticed that most who assumed the responsibility of judging were from the well known scientists and fokaha (scientists of Islamic Religion).
