For a harmonious development of the child’s personality, he should grow up in a family environment, filled with happiness and care, so every state must take appropriate measures to enable the Child support in his original family, if that is not possible statesmust recognize the adoptionor the“Kafala” or anyother system that guarantees the continuity of the Child support and caring in apermanent family, inside or outside the country, this requires taking measures to ensure that the adoption is going on in the child's best interest, and inrespect of his fundamental rights, soto prevent the abduction, sale or trafficking of children.

The Maghreb countriesand specially Algeriaworked to executethe above citedinternational standards through the ”Kafala”system andnot the adoption for religious reasons, and it precisedthe ”Kafala”procedures and the child’s rights in it,that in orderto guarantee a permanent family that will ensure stabilityfor the child .
