the peaceful use of nuclear energy is an inalienable right, it’s implementation calls for international cooperation for the transfer of nuclear technology through liberalized international nuclear trade subject to the dynamics of the market in this area, but what hinders the total freeing of this trade is the impossibility of separation between peaceful and military applications of nuclear materials and technologies, control systems (export controls) are an effective tool in this regard to ensure that nuclear trade would not prejudice the international security and stability through establishing a system of checks and balances that could not halt nuclear proliferation completely, but it managed to slow it down significantly.

The impact of these controls on the nuclear market development may be deemed negative, but the political and security concerns associated with nuclear issues make their application a necessity for the existence of nuclear trade itself.

In this research we will try to determine these formal and informal control mechanisms by analyzing their legitimacy, legally binding obligations and effectiveness in achieving their dual objective which is to stop the proliferation and not hinder the development of nuclear trade.
