Human beings have been and continue to be victims of atrocities , such as torture and serve treatment or punishment or inhuman or humiliating and degrading treatment which constitute outrages upon personal dignity, and it is worth noting that torture is one of the most reprehensible practices in both heavenly and positive law.

In spite of that , it is widespread and practiced in various part of the world.

Torture is considered as an intentional felony that is punishable by Islamic law, and there are guarantees and mechanisms that have been set up, particularly at the international level, in order to ensure that people are not subjected to this infraction .These guarantees are preventive and repressive as well .The educational and monitoring measures, as well as the national legislations can be classified as preventive guarantees.

The incrimination of torture and the reparation of victims fall under the repressive measures.
