All legislative texts regulating public transactions are keen to establish competition and transparency in the conclusion of public transactions, for what they provide variety of offers that enable management to make optimal and rational use of public funds and to provide effective protection for public funds.

Therefore, it was necessary to find ways to conclude public transactions that achieve the principle of competition and transparency.

In the Public Procurement Law 15/247, the Algerian legislator adopted the methods of solicitation and concurrence for the conclusion of public transactions for the two principles which would lead to free competition among the participants.

The two methods also encompassed a set of mandatory procedures to ensure fair and transparent transactions.
