Arabic Abstract
هدفت هذه الدراسة إلى التعرف على صكوك الإجارة كأداة من أدوات التمويل الحديثة في فلسطين و التي هي غير منتشرة في قطاع غزة و كذلك التعرف على مشكلة الكهرباء في فلسطين عموماً و في قطاع غزة خصوصاً و اسباب هذه المشكلة و ما يتعلق بالعجز المالي الذي تواجهه مؤسسات الكهرباء في قطاع غزة (شركة الكهرباء - سلطة الطاقة محطة التوليد) و ذلك للتعريف صكوك الإجارة وما لها من دور فاعل في التنمية و التمويل و إستخدم الباحث في هذه الرسالة الأسلوب الوصفي التحليلي في إستخلاص النتائج و التوصيات، تمت معالجة الإطار النظري للدراسة من خلال كتـب و المراجع العربية و الأجنبية و كذلك إعتمدت الدراسة على الأبحاث و الدراسات السابقة و تم إستخدام الإستبانة للحصول على البينات الأولية اللازمة للدراسة لتحليلها و الخروج بالتوصيات و النتائج.
و توصلت الدراسة إلى عدة نتائج أهمها أن مشكلة الكهرباء هي مستعصية و تحتاج إلى تمويل ضخم حتى يغطى إحتياجه فقطاع غزة بقعة صغيرة و تصله الكهرباء عبر ثلاث طرق هي الخطوط المصرية و الخطوط الاسرائيلية و محطة التوليد و هذه الكمية غير كافية لقطاع غزة و تحتاج أقل شيء لمحطة كهرباء إضافية و لكن المحطة تحتاج للتمويل و يمكن التمويل عن طريق صكوك الإجارة و التي هي أداة أثبتت نجاعتها في أكثر من مجال في الدول المحيطة وبالإمكان الإستفادة من صكوك الإجارة إذا توفرت عدة عوامل منها توفر البيئة القانونية و الشرعية وكذلك معرفة الجمهـور بشكل عام و تأهيل بعض المختصين بشكل خاص للإضطلاع بحجم مسؤولياتهم و كذلك رفع القيود التي تحد من سلاسة إستخدام الصكوك و سن التشريعات والقوانين التي تدعم ذلك.
و قد أوصى الباحث بالعمل على إقامة دورات و ندوات و نشرات في كافة المؤسسات للتعريف بصكوك الإجارة و دورها في التنمية و كذلك تأهيل طاقم مهني مختص للتعامل مع الصكوك في التداول و الإطفاء و الإكتتاب و التعريف بمشكلة الكهرباء و دفع المواطنين على تحمل مسؤولياتهم تجاه هذه المشكلة المزمنة.
English Abstract
This study aims at introducing the ijara sukuk as a tool for modern financing in Palestine, which is not common in the Gaza Strip, as well as to identify the problem of electricity in Palestine in general and in the Gaza Strip in particular, the causes of this problem and the financial deficit that electricity institutions face in the Gaza Strip (Electricity Company - Power Authority - Generation Station).
The study will also introduce the ijara sukuk and its effective role for development and financing.
The researcher used in this thesis the descriptive analytical approach to draw conclusions and recommendations.
The theoretical framework of this study depended on Arabic and foreign books and references for the book review.
The questionnaire was used to obtain the initial data needed for the study to analyze and make recommendations and findings.
The study reached several findings, the most important of which are the following : The problem of electricity is a difficult problem that requires huge funding to cover its needs.
The Gaza Strip is a small area and is connected to electricity through three Egyptian lines, Israeli lines and the generating station.
The amount of power received is not enough to the Gaza Strip and it requires another power station.
However, the station needs financing and can be financed through the ijara sukuk, which have been proven as a successful tool in more than one area in the surrounding countries.
The ijara sukuk can be used if there are several factors, such as the legal environment, the knowledge of people, and rehabilitation of some specialists to undertake the responsibilities as well as lifting the restrictions that limit the smooth use of instruments.
This is in addition to the enactment of legislation and laws that support the instruments.
The researcher recommended working on conducting courses, seminars and making leaflets to all institutions to introduce lease instruments and show its role in development.
The study also recommends the rehabilitation of staff to deal with instruments in circulation, fire-fighting, and underwriting.
This is in addition push citizens to shoulder their responsibilities towards this chronic problem.
