Arabic Abstract

هدفت هذه الدراسة و الموسومة بـ " المسؤولية الجنائية الفردية عن الجرائم ضد الإنسانية في القانون الدولي الجنائي " إلى بيان مفهوم المسؤولية الجنائية الدولية للأفراد وفقا للقانون الدولي الجنائي، و تطور مفهوم المسؤولية الجنائية الدولية للأفراد من مرحلة العرف الدولي الجنائي إلى مرحلة التقنين، ثم تناولت الدراسة تطور مفهوم المسؤولية الجنائية الدولية للأفراد في إطار الأنظمة الأساسية و محاكمات المحاكم الدولية الجنائية الخاصة والمحكمة الجنائية الدولية، و بيان أهم المبادئ القانونية التي جاءت بها محاكمات تلك المحاكم و التي أصبحت فيما بعد جزءا مهما في القانون الدولي الجنائي و تطور المسؤولية الجنائية الدولية.

ثم تطرقت الدراسة إلى بيان مفهوم الجرائم ضد الإنسانية و تطوره في إطار الأنظمة الأساسية و محاكمات المحاكم الجنائية الدولية الخاصة و المحكمة الجنائية الدولية و بيان صور الجرائم التي تدخل ضمن مفهوم الجرائم ضد الإنسانية.

ثم تناولت الدراسة استعراض لبعض التطبيقات القضائية في المحاكم الجنائية الدولية الخاصة في إطار محاكمات محكمة نورنبرغ العسكرية الدولية، و في محاكمات المحكمة الجنائية الدولية الخاصة ليوغسلافيا السابقة، و المحكمة الجنائية الدولية الخاصة لرواندا، واخيرا تم استعراض لاهم القضايا الجنائية المحالة على المحكمة الجنائية الدولية.

و اخيرا انتهت الدراسة بخاتمة و الاستنتاجات التي توصلت اليها الباحثة ثم توصيات الدراسة

English Abstract

This study, designed and tagged as "individual criminal responsibility for crimes against humanity in international criminal law", aimed to demonstrate the concept of the international criminal responsibility of individuals in accordance with international criminal law and the evolution of the concept of international criminal responsibility of individuals from the international custom stage To the codification stage, the study then examined the evolution of the concept of international criminal responsibility of individuals within the framework of the statutes and trials of the international Special Criminal Tribunals and the International Criminal Court, and of the most important legal principles brought about by the trials of those courts, which became Is later an important part of international criminal law and the development of international criminal responsibility.

The study then addressed the concept of crimes against humanity and its evolution within the framework of the statutes, the trials of the special international Criminal tribunals and the International Criminal Court and the statement of the images of crimes that fall within the concept of crimes against humanity.

The study then examined a review of some judicial applications in the special international criminal tribunals in the trials of the International Military Tribunal of Nuremberg, the trials of the Special International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, and finally reviewed of the most important criminal cases referred to the International Criminal Court.

Finally, the study concluded with a conclusion and the conclusions reached by the researcher and then the recommendations of the study.
