Arabic Abstract

هدفت هذه الدراسة و الموسومة بـ " وسائل القانون الدولي لمكافحة جرائم الفساد" إلى التعريف بمفهوم و ماهية الفساد و انواع الفساد وبيان اسباب انتشار و استفحال ظاهرة و جرائم الفساد، و بيان صور جرائم الفساد سواء التقليدية منها أو المستحدثة و التي تناولتها اتفاقية الأمم المتحدة لمكافحة الفساد لعام 2003 ثم تم التطرق إلى الآثار المترتبة على جرائم الفساد على المستويات الاجتماعية و الاقتصادية و القانونية و السياسية و مدى تأثيرها على العلاقات الدولية و منزلة الدول في المجتمع الدولي.

ثم تطرقت الدراسة إلى بيان أهم الوسائل الدولية المتبعة في مجال مكافحة الفساد باعتباره جريمة عالمية عابرة للحدود و ذات تأثير سلبي على المجتمع الدولي و الانساني كافة، من حيث الوسائل الاتفاقية و إبرام المعاهدات الدولية المتعلقة بمكافحة الفساد على المستوى العالمي أو على المستوى الاقليمي، أو من حيث المؤسسات الدولية الرسمية كالبنك الدولي و صندوق النقد الدولي وغير الرسمية و منظمات المجتمع المدني على المستوى الدولي ذات الانشطة المتخصصة في مجال مكافحة الفساد و اهمها منظمة الشفافية الدولية، و كذلك من حيث الإستراتيجية و التعاون الدولي في مجال مكافحة الفساد.

أما التجارب الدولية في مجال مكافحة الفساد فقد تم استعراض أهم التجارب الدولية الناجحة في مجال مكافحة الفساد و الاخرى المتلكئة و التي تعاني من الفساد، و تناولت الدراسة تجربة الولايات المتحدة الامريكية و التجربة البلغارية و التجربة النيجيرية و التجربة السنغافورية في مجال مكافحة الفساد على المستوى العالمي، و تناولت الدراسة التجربة المصرية و تجربة المملكة العربية السعودية و تجربة العراق في مجال مكافحة الفساد في إطار الدول العربية.

و اخيرا انتهت الدراسة بخاتمة و الاستنتاجات التي توصل إليها الباحث ثم توصيات الدراسة.

English Abstract

This study was designed and tagged ’’Means of International Law to Combat Corruption Crimes’’ aimed to publicize the concept of corruption, types of corruption, the causes of the spread and persistence of corruption, and the images of corruption offences, both traditional and novel, and addressed in the United Nations Convention To combat corruption in 2003, the implications of corruption offences at the social, economic, legal and political levels and the extent to which they affect international relations and the status of States in the international community were addressed.

The study then addresses the most important international means of combating corruption as a global cross-border crime with a negative impact on the international and humanitarian community as a whole, in terms of the means of the Convention and the conclusion of international treaties on combating corruption at the global level or on The regional level, or in terms of official international conferences such as the World Bank, the International Monetary Fund and informal international civil society organizations with specialized anti-corruption activities, the most important of which is International Transparency, as well as interms of strategic cooperation in the fight against corruption.

International experiences in the fight against corruption have been reviewed and the most important successful international experiences in the fight against corruption and other corruption-plagued and corrupt, the study examined the experience of the United States of America, the Bulgarian experience, the Nigerian experience and the Singapore experience in the area To combat corruption at the global level, the study examined the Egyptian experience and the experience of Saudi Arabia and the experience of Iraq in the field of combating corruption within the framework of the Arab States, Finally, the study concluded with a conclusion and the conclusions reached by the researcher and then the recommendations of the study.
