Arabic Abstract

هدفت الدراسة الحالية الى التعرف الى مفهوم القضاء الدستوري في مجال حماية حقوق الانسان، و التعرف على احكام المحاكم الدستورية التي تؤثر على حقوق الانسان و من ثم الكشف عن دور المحمكة الدستورية لضمانات حقوق الانسان في المملكة الاردنية الهاشمية و المحكمة الاتحادية في جمهورية العراق، و استخدمت الباحثة المنهج الوصفي التحليلي، و المتضمن : تحليل مضمون النصوص الدستورية ولاتفاقيات والمعاهدات الدولية التي تتعلق بحقوق الافراد الاساسية، كما استخدمت الدراسة ايضا المنهج التاريخي للكشف عن الشواهد والأحداث التي شهدها الصعيد الدولي في التعارض ما بين القضاء الدستوري و حقوق الافراد الاساسية للكشف عن تأثير القضاء الدستوري على حقوق الافراد الاساسية، و بيان أبرز الحقوق تأثرا بالقضاء الدستوري.

و توصلت الدراسة الى عدة نتائج من اهمها أن قد ساهمت المحكمة الدستورية الاردنية في ترسيخ حقوق الانسان، كما ان المشرع العراقي عالج من خلال القانون الدستوري حقوق الانسان الحق في الحياة و الأمن، و قد عكس الدستور العراقي الحقوق والحريات في ظل صورة الدولة القانونية او شرعية الدولة بمدى التزامها بالدستور و القوانين الاساسية النافذة والتي لابد من ان تكون متضمنة لمجموعة من الحقوق و الحريات الاساسية للأفراد مع ضمان احترام هذه الحقوق و الحريات.

و استطاعت الباحثة الخروج بالتوصيات من اهمها ان الرغم ان المحكمة الدستورية الاردنية و المحكمة الاتحادية العليا العراقية، قد اهتمتا بحقوق الانسان في التشريعات و الاحكام، الا ان هنالك بعض الثغرات الناتجة عن مستجدات العولمة و ما نتج عنه من وسائل التواصل الاجتماعي، كما ان هنالك ضرورة موائمة التشريعات المطبقة من قبل المحكمة الدستورية الاردنية و المحكمة الاتحادية العليا العراقية، بحيث تنسجم مع معطيات المواثيق الدولية لحقوق الانسان الصادرة عن الامم المتحدة.

English Abstract

The present study aimed to identify the concept of constitutional justice in the field of human rights protection, and to identify the constitutional courts that affect human rights and thus reveal the role of constitutional monarchy for the guarantees of human rights in the Hashemite Kingdom of Jordan and Federal Court of the Republic of Iraq.

The study also used the historical method to uncover the evidence and events that occurred at the international level in the conflict between the constitutional judiciary and the rights of basic individuals to detect the impact of the judiciary.

Constitutional rights of basic individuals, and a statement of the most important rights affected by the constitutional judiciary.

The study reached several results, the most important of which was that the Jordanian Constitutional Court contributed to the establishment of human rights.

The Iraqi legislator also dealt with human rights with the right to life and security.

The Iraqi constitution reflected the rights and freedoms under the image of the legal state or the legitimacy of the state.

And fundamental laws in force which must be included in a set of fundamental rights and freedoms of individuals while ensuring respect for these rights and freedoms.

The researcher was able to come out with the recommendations, the most important of which is that although the Jordanian Constitutional Court and the Supreme Federal Court of Iraq have taken care of human rights in legislation and provisions, there are some gaps resulting from the developments of globalization and the resulting means of social communication.

Before the Jordanian Constitutional Court and the Supreme Federal Court of Iraq, in line with the data of international human rights instruments issued by the United Nations.
