Arabic Abstract

تناولت هذه الدراسة حق المساواة في القانون الدولي لحقوق الإنسان، من منطلق أنه بالرغم من أن القانون الدولي نص صراحة في المواثيق الدولية و الإعلان العالمي لحقوق الإنسان و التشريعات الوطنية على مبدأ حق المساواة، إلا أنه ما زال يكتنف بطابع الغموض في تحديد مضمون حق المساواة، و في الضمانات اللازمة لتطبيقه، فالمواثيق الدولية لم تنص صراحة على الوسائل الكفيلة بضمان حق المساواة، واكتفت فقط بضرورة صيانة هذا الحق، فجاءت هذه الدراسة لبيان مدى الأخذ بحق المساواة وتطبيقه في القانون الدولي لحقوق الإنسان و في القانون الأردني؟ فبينت الدراسة أن جميع الرؤى الفلسفية التي عالجت موضوعات حقوق الإنسان تؤكد على وجود علاقة بين الطبيعة البشرية والقانون الطبيعي.

و قد ساهمت هذه الرؤى بعناصر أساسية للتطور الذي حصل في مجال حقوق الإنسان كما أن الدول اتخذت مجموعة من التدابير المناسبة للقضاء على التمييز بين الأشخاص بما في تلك الجهات الحكومية والأشخاص والمنظمات.

و خلصت الدراسة إلى جملة توصيات منها على المشرع الأردني سن قانون خاص للمساواة وعدم التمييز بين الجنسين، يشمل كل من القطاعين العام و الخاص، ويغطي المجالات المدنية و السياسية و الاقتصادية و الاجتماعية و الثقافية و أي مجالات أخرى، وأن يتضمن تعريفا واضحا للتمييز ضد المرأة، و أحكاما بشأن تساوي المرأة مع الرجل في الحقوق، و أن يتضمن عقوبات وسبل إنصاف ضد الإجراءات التمييزية القائمة على الجنس.

كما أوصت الدراسة بأنه يجب على الدول الأعضاء في الأمم المتحدة، وخاصة أمريكا وحلفائها، أن تبدي قسطا أكبر من الالتزام ومن الرغبة السياسية لمنح آليات حقوق الانسان ما تقتضيه من مكانة وسلطة وقدرة على اتخاذ الإجراءات الفاعلة.

English Abstract

This study deals with the right to equality in international human rights law, based on the problematic nature of the fact that although international law explicitly states, in the international instruments, the Universal Declaration of Human Rights and national legislation, the principle of the right to equality, it remains ambiguous in determining the content, and in the safeguards required to apply it.

International instruments have not explicitly stated the means to guarantee the right to equality, but rather the need to preserve this right.

This study has aimed at clarifying the nature of the right to equality, its content, its sources and its mechanisms of application in Jordanian law and international human rights law.

It has been found that all the philosophical visions that have dealt with the subjects of human rights confirm that there is a relationship between human nature and natural law.

These visions have contributed to the development of human rights.

States have taken a range of appropriate measures to eliminate discrimination between persons, including those governmental bodies, persons, organizations and private enterprises.

The study has concluded with a number of recommendations, including : The Jordanian legislator should enact a special law on equality and non-discrimination between the sexes, covering both the public and private sectors, covering the civil, political, economic, social, and cultural and any other fields, including a clear definition of discrimination against women, provisions on the equal rights of women and men, penalties and remedies for gender-based discriminatory measures.

The Member States of the United Nations, particularly the United States and its allies, must show greater commitment and political will to give human rights mechanisms due to its status, authority and ability to take effective actions.
