Arabic Abstract

ساهم التطور العلمي الهائل الذي يشهده العالم، و ما نتج عن هذا التطور من وسائل علمية حديثة في أدلة الاثبات الجزائي، حيث ساهم هذا التطور في استحداث أساليب ووسائل التي يستند اليها القاضي الجزائي في تكوين قناعته الوجدانية في ايقاع العقاب وتجريم المجرمين، بالاستعانة بالادلة الفنية المتمثلة بالتسجيلات الصوتية و التصوير المرئي.

إن الهدف الأساسي من هذا التطور العلمي هو محاولة الحد من الجريمة وتسهيل اكتشافه لدى السلطات المختصة.

شرعنا في اعداد هذه الدراسة، و ذلك انطلاقا من الحاجة الماسة الى الوقوف على حجية المستخرجات الصوتية والمرئية في الاثبات الجزائي.

ومن هنا جاء اهتمام الباحث لبيان ماهية التسجيلات الصوتية، سواء التي يتم الحصول عليها عن طريق الهواتف النقالة، أو الحصول عليها عن طريق اجهزة الالتقاط الصغيرة " و ماهية التصوير المرئي.

حيث ان الدراسة قد أوصت بانه يتوجب على المشرع الاردني ان يحدد موقفه صراحة من الادلة الفنية التي تساهم في تكوين القناعة الوجدانية لدى القاضي الجنائي من جهة ويقيد الاستناد الى هذه الادلة بضوابط وقواعد لعدم انتهاك أو المساس بالحياة الخاصة للأفراد من جهة أخرى.

English Abstract

The tremendous scientific development as the world seeing, and the results of the development of modern scientific means in criminal evidence.

This development has contributed to develop a new methods and way’s that based by the criminal judge, in the formatting of his emotional conviction in corporal punishment by using the technical evidence of audio recordings and visualization The main objective of this scientific development is to attempt to control the crime, and to facilitate it’s discovery by the relevant authorities.

We have embarked to prepare this study, on the basis of the urgent need to identify the argument of audio and visual extracts in proof.

Hence, the researcher’s concern to explain the significance of the criminal evidence, its importance, it’s objectives in criminal procedures and the types of criminal evidence and its seriousness in the evidence.

This study dealt with the definition of what sound recording, whether obtained through mobile phones or by small pick –up devices by demonstrating its concept, the most important ways to obtain, the position of jurisprudence, the comparative legislation and the validity of each one.

It also shows of what the visualization, its characteristics, the most important ways to obtain it, the position of juris prudence, the comparative legislation and validity of each one.

The study also recommended that the Jordanian legislator should determine his position on the technical evidence of audio – visual recording.

That contributes to the formation of the emotional conviction of the crimmal judge on the one hand, and to restricts the evidence – based with rules and regulations of non- violation life.
