English Abstract

The study has aimed at dealing with the civil responsibility of the witness in the Jordanian Civil Law, "comparative study".

The problem of the study has been about the explaining when the civil responsibility of the witness for his harmful action is established, and when it is denied? Based on an attempt to solve the problem of the study and its hypotheses, the researcher has followed the analytical approach, in which she has analyzed the related legal texts, the judicial rulings, if any, and the studies and jurisprudential opinions that have been exposed to this subject.

The study concluded that the Jordanian legislator did not specify specific provisions for liability for the harmful act of doctors, engineers and witnesses.

However, the general provisions in tort liability are referred to the personal act and applied to the civil liability of the witness for his harmful actions.

The damage caused by the witness, who is the subject of the "tort liability", is of an objective nature.

As long as the witness has done harm to others, he is obliged to compensate them, whether he is aware of what he is doing or not.

In conclusion, the study concluded with a number of recommendations, the most important of which is the need for the Jordanian Evidence Law to contain a text stating that the performance of the contrary certificate of truth requires compensation to the injured party in accordance with the general rules when necessary.

And the need for the Jordanian Civil Code to include a text stating that the time for estimating compensation is at the time of the injury and not at the time of the judgment.
