English Abstract

The owners of vicinal copyrights that to author right fall under three categories; 1) performance artists: Such as artists, singers, dancers and else who recite, sing, play or perform, in any image, artistry, literal works and else; 2) Phonograms producers, who are natural or legal persons recording voices of performance artist and; 3) Broadcasting bodies, that run transmission process of such works of all types.

The vicinal copyrights owners have group of literal and financial rights to the performance artist in his capacity as author, financial rights only to Phonograms producers and broadcasting bodies, as their business is free of creation and innovation.

The Arab regulations defined terms to protect such rights and explained the relationship nature between such rights owners and author right.

The French judiciary had its role toward such issue.

The works include personal works that show who is the author that is protected under law, cases or images of composing.

It includes also what is called spatial that relate to method of equality between citizens & foreigners, thence the objective domain that tackles the composed article and its conditions.

On the other hand, the works, which are protected were not stated exclusively, but the regulations stipulated thereof as examples.

In the same time, some of it were excluded from protection, and others were subject to legal and juristic dispute.

Multiple's images of assault on literary, scientific and artistry works took place; theft, counterfeiting, piracy and distortion.

All such images are prohibited by the regulations.

Protection means have been set out via, either special means that include works deposit at libraries, competent entities, sanctions imposed on non-deposition thereof or procedural protection means that include conservative measures.

Such measures are made available in the regulations to stop such assaults on the work, performance artist, phonographs and broadcasting bodies.

The aforesaid persons and bodies are allowed to seek legal channels to punish such assaulters through competent court who shall fix suitable compensation as to such assaults.

However, the winning plaintiff shall be able to publish the court judgment and invest it to its own interest.
