تسعى هذه الورقة البحثية للكشف عن حقيقة الاستطاعة ومدى مراعاتها في التكليف الشرعي، إذ أن الشارع الحكيم راعى في أحكامه الشرعية مدى قدرة المكلفين على الأداء التكليفي وسعتهم وطاقتهم على القيام بذلك، فكانت الاستطاعة مناط التكليف ومستند الأحكام الشرعية وأساس بناء القواعد الفقهية، وهذا يثبت أن الشريعة الإسلامية جاءت باليسر ورفع الحرج عن المكلفين ومراعاة أحوالهم وظروفهم القائمة على الاستطاعة والقدرة والإمكان، فلا تكليف بما لا يطاق.
Abstract EN
This article seeks to reveal the reality of the ability and the extent to which it is observed in the application of the Judgments Shariah.
In its Sharia Judgments, Allah has taken care of the ability of people to perform and their energy to do so, This indicates that the Islamic law came easily and lift the embarrassment of people and take into account their conditions that are subject to capacity.
