English Abstract
In order to prevent the risk of serious damage to the environment which is uncertain due to current scientific and technical knowledge, the precautionary principle has been established under Article 30, paragraph 8, of law No03-10 of 19 July 2003.
In this study, we will address the legal requirements to apply the precautionary principle, the difficulties facing the judiciary as well as the moral and natural persons in its application and then the research on the legal mechanisms to activate precautionary principle.
