The capitain is considered the most important navigatort , this importance is felt when the vessel is at sea and is not in the hands of the state authorities and thebcontrol of the state autorities and the control of the supplier.This gives him a unique legal status that has no parallel in hand,the fact that the shipselationships on the ship are different from the land_based relationships .Hence his special carees status makes it possible to define the legal framework for holding his use surrouded by ambiguity one the hand, and one the other hand this career status makes him enjoy exception al powers enabling it to fulffill its obligations this makes it mor difficult to determine its legal status.

Tis prompted us to clarify this ambiguityin the folds of this research.
