Custody is one of the most important issues that provide physical and moral protection for the child as a result of the death or divorce that may occur between the spouses, which may result in conflict in the issue of custody, which can lead to abuse of their right.

The problem is: How does the Algerian legislator deal with the abuse of custody in comparison to Islamic Fiqh ?
