This study deals with the problem of determining the quality of the maritime carrier in marine transport disputes in the Algerian law, whether it is to determine the latter's status in maritime continuing transport or to determine its status in the charterparty.
Indeed, the latter often creates some difficulty in distinguishing between the quality of the maritime carrier and that of the landlord.
Therefore, the researcher follows up the difficulties in determining the quality of a maritime carrier in maritime transport disputes
Abstract FRE
La présente étude a pour objet de mettre l’accent sur la problématique de la détermination de la qualité du transporteur maritime en matière de contentieux maritime.
Il s’agit ici de la qualité de ce dernier aussi bien dans le transport successif que dans la charte-partie.
En effet, ce dernier pose, dans bien des cas, une difficulté quant à la distinction entre la qualité du transporteur maritime et celle du locataire.
Ainsi, on se demande quelles sont les difficultés auxquelles se heurte la détermination de la qualité du transporteur maritime dans le contentieux en question.
