Abstract EN

The idea of this research has dealt with the change of Islamic ruling in the context of economic issues through the stages of the economic cycle which moves from one stage to another in a circular manner, bearing in mind that these stages are the following: recession, depressions, recovery and prosperity.

The research aimed at reaching an Islamic economic ruling that can be relied upon in issuing Shari’a economic judicial rules during the change in the stages of the economic cycle.

In this study, the researcher used the following methodologies: the inductive, the deductive and the analytical methods.

Several findings were obtained, the most important of which was the categorization of the stages of the economic cycle into four states: recession, depression, recovery and prosperity.

These categories must be endorsed since they are in conformity with economic norms which are different from the Old Islamic categorization of economic cycle into prosperity and intensity.

The researcher formulated the following economic jurisprudence rule: “the change of economic Islamic rules with the change of the stages of economic cycle is not denied”, as this contributes to the issuing of Shari’a rulings in relation to economic issues.

The researcher ended his research with a recommendation to scholars in Islamic Economics as well as in Legal Advice and Legislation Departments, including the Fiqh councils, demanding them to take into account the reality of the various stages of the economic cycle during their studies of jurisprudence verdicts on the raised economic issues.
