Abstract EN

The study is a field documentary that is aimed at explaining the meaning of Minha (grant) in the UAE custom when assigned to an accredited charitable institution.

It adopts a scientific methodology and a modern approach in presenting the concept of Minha in jurisprudence and in the UAE custom.

The study also seeks to authenticate this concept, specify the required documents related to it, and explain the holding of investment, in addition to drawing on other relevant issues.

These issues include: the legal personality of Dar Al-Bir association, the management of Waqf (endowment), the penal conditions imposed on the investor, as well as the issue of the financial penalty for returned checks.

The study came to a number of conclusions and recommendations, including: the land granted by the ruler to a charitable organization is considered a kind of Waqf (interpreted as a gift) in Emirati customs, and the necessity of legislating a federal law that regulates Waqf and ensures its sustainability.
