Abstract EN

This research, entitled “Islamic Ruling on Obliging the Offender to Choose a Specific Method of Diyya (Retribution) Payment in Islamic Fiqh”, comprises three main parts, an introduction and a conclusion.

The researcher dealt with the concept of Diyya as seen by Islamic jurists.

A Diyya is money paid in retribution for a committed crime that led to the loss of a person’s life or other parts of the body.

There are three permissible methods of payment: camels, gold and silver, bearing in mind that the general rule is to give the culprit the freedom to choose out of the above three methods.

The importance of this study, at present, lies in the fact it shows the extent to which it is legitimate to force the offender to choose a specific method of Diyya payment, because people have different attitudes due to the difference of the retribution value in the three methods.

The most preferable procedure is to oblige the culprit to pay the value in gold, in view of the stability of its purchasing power
