Abstract EN

This research analyzes previous and contemporary Waqf investment forms in Islamic Shari’a.

It seeks to determine the nature and reality of this investment, its compliance with Shari’a rules, the risks that the investing party might face while investing Waqf funds, the impact of emergency conditions on its investment, as well as the legitimacy and economic controls which govern the process of investing these funds.

This is added to referring to law number (4) of 2011 regarding Waqf.

The researcher used in his study the comparative and inductive research method.

In conclusion, the researcher found that the investment of Waqf funds means their development, whether they are assets or a return on investment by means of permissible Islamic investment forms, and within the terms of Islamic jurisprudence controls.

Some of Waqf investment forms are: “Ijarah”, “mudarabah”, and the system of Build Operate Transfer.

These forms are exposed to a range of risks.

The researcher recommended providing more attention and care for Waqf funds to keep them away from recession and obstruction and to achieve economic growth.
