يتصادم التياران اللذان يمثلان كل من مدرسة الحق في التداول الحر للمعلومات و مدرسة حقوق الملكية الفكرية فيما يمكن تسميتها بالمواجهة، في العديد من نقاط الخلاف التي جعلت كل طرف يصل إلى مرحلة التشكيك في مشروعية المطالب التي ينادي بها الطرف الآخر، و في ظل صراع إثبات الوجود و إنكاره على الغير بين هاتين المدرستين، يظهر إلى الوجود طرف ثالث يمثل التيار غير المتشدد من مدرسة الحق في التداول الحر للمعلومات ليعمل على إحداث الموازنة بين هذين الحقين الإنسانيين بغية إنفاذهما معا، و دون مساس بالحقوق والحريات ذات الصلة المحمية و المكفولة قانونا، و على هذا الأساس أمكن لنا طرح الإشكالية الرئيسية لهذه الدراسة على النحو الآتي : - ما مدى اعتراف قوانين الملكية الفكرية الوطنية و الدولية بحق الأشخاص في التداول الحر للمعلومات ؟
Abstract EN
In what may be called confrontation, the two currents that represent the right school in the free circulation of information and the school of intellectual property rights collide in many points of contention that have made each party reach the stage of questioning the legitimacy of the demands advocated by the other party.
And in the face of the struggle to prove existence and deny it to others, a third party representing the positive trend of the School of Free Access and Sharing of Information comes to work to strike a balance between these two human rights in order to enforce them together, without prejudice to the rights and freedoms that are protected by law.
