Abstract EN

this research paper presents the differences on the subject of adultery in Islamic sharia, which is considered a heinous crime affecting the safety of society, and imposed the most severe punishment on their perpetrators, like stoning of the married and whipping and exiling of non-married.

While most of the penal laws of Arab countries narrowed the concept of adultery and limited it in the sexual relations of one of the spouses with a third party.

Excluded from this criminalization the sexual relations happened outside of marriage, which are consensual between the parties.

In addition, these laws have imposed imprisonment for the perpetrators of this crime, with a difference on the duration of it.

And on the contrary, due to social changes and cultural changes that the world has witnessed for two centuries, international law makers have removed the status of criminalization and punishment from all sexual relations carried out by people in or out of marriage, considering them to be a violation of many human rights.
