Arabic Abstract

في ظل التطور التكنلوجي في العصر الحديث، و انتشار شبكة الإنترنت في مجتمعاتنا، حدثت تطورات موازية للخطر الإجرامي الذي يتربص بالطفل، و ذلك بأن يقع الطفل ضحية لجريمة الاستغلال الجنسي و إفساد الأخلاق عبر الإنترنت، فأي خطر أكبر من تهديد الطفل في سلامته الجسدية و الأخلاقية، فهذه الجريمة التي ما فتئت ترتكب ضد الأطفال حتى كادوا ينقسمون بين ضحية لهذه الجريمة أو مهدد بها.

و انطلاقا من أهمية الطفل كعنصر أساسي في مجتمعاتنا، و أن حماية جسد الطفل وكرامته و أخلاقه من حقوق الطفل التي نادت بها الشريعة الإسلامية وجميع التشريعات الوطنية و الدولية، ارتأى الباحث أن يقدم هذه الدراسة عن جريمة الاستغلال الجنسي للطفل و إفساده من خلال الإنترنت.

تبحث هذه الدراسة في جريمة الاستغلال الجنسي للطفل و إفساده عبر الإنترنت، و تتضمن مقارنة بين التشريع الفرنسي، و المصري، و الأردني، و قامت هذه الدراسة على تقسيم هذه الجريمة الى جريمتين، لكل منهما صورها، و أركانها، و نصوص تشريعية تعالجها، و هما : .

جريمة إفساد الطفل عبر الإنترنت .

جريمة الاستغلال الجنسي للطفل عبر الإنترنت و قد توصلت هذه الدراسة الى مجموعة من النتائج و التوصيات لعل من أبرزها : .

استخدم المشرع الأردني مصطلح (الدعارة) في الفقرة (ج) من المادة التاسعة في قانون الجرائم الالكترونية، مع أن هذا المصطلح جديد على المشرع، فقد استخدم مصطلح (البغاء) في قانون العقوبات، فالدعارة تختص بالإناث دون الذكور، و المشرع أراد حماية كل من الجنسين.

أوصى الباحث بأن يقوم المشرع الأردني بتجريم حيازة المحتوى الإباحي الالكتروني و تجريم تداوله خارج نظام شبكة المعلومات، (كأن يتم نسخه على أقراص الكترونية و من ثم تداوله بين الأشخاص).

English Abstract

In the light of the recent technological development, and the wide spread of the internet in our societies, parallel developments happened in the criminal risk that threatens children, that a child becomes a victim for sexual exploitation and moral corruption through internet; that there is no bigger danger than threatening child’s moral and physical safety! This crime which has been committed against children and divided them into victims or threatened.

Since the child is a main element in our societies, and protecting his body, dignity, and morality are of child rights that Islam and all national and international legislations have called for, the researcher decided to present this study about the crime of child’s sexual exploitation and corruption through internet.

This study discusses the crime of child sexual exploitation and corruption through internet, and it contains a comparison between the French, Egyptian, Jordanian legislations.

And it also divided this crime into two crimes, each crime has its types, sections, and legislative texts that deal with it, and the crimes are: •The crime of child corruption through internet.

•And the crime of child sexual exploitation through internet.

And the study comes out with a group of results and recommendations, and the most important ones are : •The Jordanian legislator used the term (whoredom) in the paragraph (c) of the ninth article in the electronic crimes ordinance, despite that this term is new for the legislator, that in the penal code the term (prostitution) has been used, since (whoredom) is specialized for females only, and the legislator wanted to protect the both genders.

•Also, the researcher has recommended that the Jordanian legislator must criminalize the possession of the electronic pornographic content and criminalize its circulation outside the network system (such as copying it on electronic disks and then exchanging it among people).
