Arabic Abstract

عالجت هذه الدراسة، جريمة الاتفاق الجنائي التي يعد العقاب عليها استثناء على قاعدة أن المشرع الجزائي لا يعاقب على مرحلة التفكير و العزم الجنائي، فهي تشكل إذا خروجا من قبل المشرع الجزائي عن هذه القاعدة.

و لقد خصت هذه الدراسة بالتشريعين الأردني و المصري، اللذين انتهجن نهجا مختلفا تماما عن بعضهما في التصدي لهذه الجريمة، حيث أن المشرع المصري عاقب على الاتفاق الجنائي المطلق و اعتبره جريمة مستقلة، اما المشرع الاردني فلم يعاقب إلا على بعض الاتفاقات الجنائية الخاصة التي تتميز ببعض الخطورة كالمؤامرة و الاتفاق الجنائي الوارد في ماده 157 بشكل خاص، وفقا لمنهجية وصفية تحليلية حيث تم التصدي لجريمة الاتفاق الجنائي في القانونين الأردني و المصري من الجانب الموضوعي المتضمن لأركان الجريمة و المسائل المتصلة بها، و من الجانب الإجرائي، المتضمن للأصول الإجرائية في الملاحقة و المحاكمة و العقاب على ارتكاب هذه الجرائم.

و في نهاية الدراسة توصل الباحث لمجموعة من النتائج و التوصيات، أهمها إن جريمة الاتفاق الجنائي لا يشترط فيها توافر عناصر الركن المادي الثلاث بل يقوم ركنها المادي على السلوك فقط، كما يشترط لقيام هذه الجريمة تعدد الجناة أي أن يتم بين شخصين أو أكثر، أما أهم التوصيات فتمثلت بأن يتم إفراد عقوبات خاصة للمحرض تكون بنفس عقوبة الفاعل، و أن يكون اختصاص النظر في هذه الجريمة في القانون الأردني من اختصاص المحاكم النظامية، مع إبراز أهم الثغرات التشريعية، و النقاط الإيجابية التي اعتمدها المُشرعان في تصديهما لجريمة الاتفاق الجنائي.

English Abstract

This study treats the crime of criminal agreement which punishment depends on the base that the penal legislator does not punish stage of thinking and criminal intention; so, it shall consider that the penal legislator excludes this base.

As this study reviews both Jordanian and Egyptian legislations which have two different ways in facing this crime.

As the Egyptian legislation punished the full criminal agreement and considered it as an independent crime.

Whereas Jordan legislation doesn't punish but some special criminal agreements which indicate dangerousness such as the conspiracy and the criminal agreement specially indicated in article 157 according to analytical descriptive process.

So, Jordan and Egyptian law faced this crime objectively mentioning crime elements and related matters, and executively indicating executive origins in following up, trial and punishment for committing such crimes.

At the end of the study, the researcher found out some results and recommendations which most important thing shall be that the crime of criminal agreement is not conditioned by three materialistic element, but it shall depend on behavior only.

In addition, such crime conditioned to have multi criminals, as it shall be between two persons or more.

Whereas recommendations are represented by the matter that the abettors shall face special punishment the same as doer punishment.

And regular courts shall be the competent authority to view such crime in Jordan code, in addition to put light on the most important legislative gabs, and the positive points that both legislators depend on in facing the crime of the criminal agreement.
