Le référé relatif aux marchés publics est une voie de recours contentieux en matière administrative ouverte aux tiers à un contrat des marchés publics.
Il s’applique conformément aux dispositions des articles 946 et 947 du code de procédure civile est administrative, en cas de manquement aux obligations de publicité et de mise en concurrence auxquelles est soumise la passation de certains contrats des marchés publics.
