According to the general rules of judicial competence, the civil action is submitted to the civil jurisdiction, the Civil Code and the Civil and Administrative Procedure Code.
Otherwise, the penal action is submitted to penal justice and to Penal Code and the Penal Procedure Code.
Since the victim of a crime has the right to bring her damage action before the civil or penal court.
The bringing of the civil action before the Penal Court as an exception leads to important effects in relation to the dependency, the civil procedure and the obligation to decide in both actions, but the civil action is still independen

Selon les règles générales de la compétence judiciaire, l’action civile relève des juridictions civiles et obéit aux règles du Code Civil et celles du code des procédures civiles et administratives.
L’action pénale relève des juridictions pénales, et obéit au Code Pénal et celui des procédures pénales.
Vu le droit d’option, la victime présenterait son action en réparation du dommage né de l’infraction devant la juridiction civile ou pénale.
Sa présentation devant cette dernière engendre des effets importants en raison de la soumission de l’action civile à l’action publique tout en préservant son indépendance et sa spécificité.
