English Abstract

The basic principle is that medical error is permissible to be proved with all methods of proofs, it must fortify the committee which formed by the Ministry of Health in a legal term, which makes it mandatory to work with that Committee to adjust these conditions, to ensure its neutrality of its members, who have morals and known reputations, and to be working under the supervision of the Public Prosecution.

If the obligations of conduct are non-specific commitments, it does not prevent the existence of specific commitments, that can be implemented and that the use of the court specialists and experts does not mean that they decide that it is the faults of the doctor decide whether or not, but the final word must only be to the court.

It should be on behalf of an independent legal competent investigation unit of medical errors and not rely on the committees formed by the Ministry of Health during the investigation by the competent prosecution and ensure that no confidential dominance of the medical practice, and inform people who are present with the patient, and the competent institutions about the medical practice from the time of entry of the patient until his discharge of the hospital.
