English Abstract

Happens in real life that the doctor of wrongdoing, whether in the diagnosis of diseases or to treat, and this error is plus civil liability, does the general provisions of civil liability applicable to the responsibility of the doctor for professional mistakes? The study dealt with the answer to this question by demonstrating the concept of medical error and forms and manifestations, the study examined the type of applicable civil liability of the doctor in case of breach of duty and we determined that jurisprudence and the law agree that the responsibility of the doctor to be dogmatic when it comes to treating the patient at his request due to the existence of a contract between the doctor and his patient.

The doctor negligence leads to accountability.

We have determined that the legislature did not put into law the responsibility and liability of a private doctor, but assesses a civil liability of medical errors or malpractices, according to the general rules.
