Abstract EN

The Palestinian constitutional proposal asserts the legality of forming administrative courts specialized in administrative and punitive cases.

It temporarily forwarded the tribunal's jurisdiction of these courts to the High Court till the establishment of the administrative judiciary.

Pursuant to the Basic Law, the Palestinian Legislative Council suggested a proposal for the Palestinian State Council Law in 2005 which tackles establishing administrative courts, administrative courts specialization, litigation procedures before administrative courts and methods of appeal against their judgments .

This proposal addresses the reality of administrative judiciary and suggests its future vision.

We concluded the necessity of enacting and issuing of the Palestinian State Council Law and establishing the administrative judiciary; administrative courts, punitive courts, administrative courts of appeal, administrative high courts and applying the principle of litigation on two stages which is one of the main principles of the right of litigation
