حجية تقنية البصمة الوراثية (DNA)‎ و أثرها في إثبات النسب في الفقه الإسلامي

Abstract EN

This research tackled an important issue from the issues of the contemporary proof in the Islamic jurisprudence, namely the DNA and its evidence in Islamic jurisprudence.

This spectacular scientific discovery, the DNA, was highlighted by emphasizing a number of related concepts, reaching its impact on proofing the ancestry in the Islamic jurisprudence.

Consequently, it has been shown that the DNA is more effective than the lot and Physiognomy, due to its accuracy.

Therefore DNA should be considered similar to Physiognomy or even more effective way.

Additionally, the study found that DNA analysis is a new and powerful way to prove ancestry, under the condition of providing the legal and technical restrictions that are valid for DNA and its results.

Finally, DNA has been adopted by many jurisprudential councils, and by the laws of states, as a means of proofing ancestry within specific rules and regulations
