Abstract EN

The right of public health considered as one of the most important human rights endorsed by the divine laws, constitutions, international and national laws, because of its importance in the preservation of human growth and life, there would be no meaning of the right of life, which is the most sacred rights, without ensuring and confirmation of the right of public health, which is witnessing many intentionally violations of human.

that led to the intervention of criminal law to protect this right through criminalizing every act or omission would violate this right, whatever the shape of such violation, which could be through trading or acquisition of corrupt, adulterated or unclean foods, also it may be by polluting the water or air spoiling in a way that detrimental to human health.

It is affirmed that national legislations have turned its attention towards public health by criminalizing every act or omission which violate it, and when a human cannot survive without food or consumption goods, so the criminal law intervened by developing substantive rules for protection of those materials, including guarantees no harm to health nor threaten to his life.

For that, the provisions of the Penal Code and specialized laws in Palestine criminalized every activity would lead to deal with spoilt foods in separate texts, which shall be explained out in this study titled " anti-crimes of dealing with harmful foods and material according to the Palestinian legislations.
