إن إقرار الجزائر التوجه نحو اقتصاد السوق جعلها تدخل مجموعة من الضمانات التي تهدف إلى حسن تنفيذ الصفقات العمومية، و من بينها إيجاد تسوية ودية للنزاعات الناتجة عن تنفيذها، إما عن طريق لجان الصفقات المختصة، أو باللجوء إلى الطرق البديلة لحل النزاعات الناشئة عنها.
و في هذا الصدد، ساير المشرع الجزائري التشريعات المقارنة من خلال السماح باللجوء إلى التحكيم لحل النزاعات الناشئة عن تنفيذ الصفقات العمومية، لذلك تثار الإشكالية في ورقة البحث حول ما المقصود بالتحكيم في الصفقات العمومية ؟ و ما هي الإجراءات المتبعة لتسويته عن طريقه ؟
Abstract EN
The adoption of a market economy Algeria make interference set of safeguards aimed at proper implementation of public contracts, including finding an amicable settlement of disputes arising from implementation , either by competent committees of transactions, or by resorting to alternative ways to resolve disputes arising there from.
In this regard, sawyer Algerian legislator comparative legislation by allowing the resort to arbitration to resolve arising from tone implementation of public procurement disputes , so the problem raised in the paper about this research is intended to arbitration in public contracts? What are the procedure to be settled on the way?

L’Algérie ayant opté pour l’économie de marché, chose qui l’oblige à adopter un ensemble de garanties qui assurent une bonne exécution des marchés publiques et parmi elle arriver à résoudre à l’amiable de contentieux y relatif.
A cet effet, le législateur Algérien a suivi les législations comparées , à travers la permission de l’usage à l’ arbitrage pour résoudre les différents surgissant de l’application des marchés publiques , pour celer le problème soulevé dans cette élaboration est comme suit: Qu’est ceque l’arbitrage dans les marchés publiques?, et quelles sont les procédures à suivre pour les résoudre ?
