Les menaces croissantes que posent les problèmes environnementaux au niveau mondial ont entraîné l’apparition de plusieurs termes et droits, parmi lesquels la prise de conscience environnementale liée à la mondialisation de l’économie et du commerce mondiaux et l’émergence de nouveaux droits de l’homme, notamment le droit à l’environnement, le droit au développement et le droit aux ressources naturelles.

Cet intérêt international a à son tour contribué au développement d'une nouvelle branche du droit public international, le "droit international de l'environnement".

Les pays développés ont élaboré des normes environnementales prévoyant des niveaux élevés de protection de l’environnement alors que les pays en développement n’ont pas été en mesure de se payer et n’ont pas pu accéder aux marchés étrangers.

Ces critères sont devenus une des formes de protection.

L’objectif de l’Organisation mondiale du commerce est d’aborder ces mesures punitives sous la forme de normes environnementales et de concrétiser l’idée selon laquelle "le développement et l’environnement sont des concepts complémentaires», l’environnement est une ressource pour le développement et son statut est une mesure importante.
