تسعى الجزائر إلى تطوير الاستثمار و تشجيعه مع حماية البيئة بحكم أن هذه الأخير تعد المحيط المادي الذي يعيش فيه الإنسان بما يشمله من ماء و هواء و فضاء و تربة و كائنات و منشآت لإشباع حاجاته.
الذي دفع بالمشرع إلى تعديل عدة مرات قانون الاستثمار.
و من هنا يتبين مظهريا أن المشرع أراد تكريس فكرتين تبدوان واقعيا متناقضتان و هما تشجيع الاستثمار لتحقيق التنمية و الحفاظ في آن واحد على البيئة لأجل الاستمرار في تحقيق التنمية.
و لذلك بد لنا التساؤل حول معرفة عما إذا حقق المشرع الجزائري التوازن بينهما.
Abstract EN
Algeria seeks to develop and encourage investment while protecting the environment because it is the physical environment in which man lives, including water, air, space, soil, objects and facilities to meet his needs.
This led the legislator to change t he l aw o n investments several times.
It therefore seems, that the legislator intended to develop two ideas that seem contradictory, namely: to encourage investment to achieve development while preserving the environment to continue to achieve development.
We must therefore ask ourselves if the Algerian legislator has reached a balance.

L'Algérie cherche à développer et à encourager l'investissement tout en protégeant l'environnement car c'est l'environnement physique dans lequel vit l'homme, y compris l'eau, l'air, l'espace, le sol, les objets et les installations permettant de satisfaire ses besoins.
Ce qui a amené le législateur à modifier plusieurs fois la loi sur les investissements.
Il semble donc que le législateur ait voulu élaborer deux idées qui semblent contradictoires, à savoir: encourager les investissements pour parvenir au développement tout en préservant l'environnement pour continuer à réaliser le développement.
Nous devons donc nous demander si le législateur algérien a atteint un équilibre.
