أهتم المشرع الوطني على غرار باقي التشريعات بحماية الطفل، حيث أدرج حماية حقوق الطفل في دستور 1996 و جسدها في التعديل الدستوري لسنة 2016.
كما تضمن قانون العقوبات هذه الحماية بإقراره نصوصا خاصة تعاقب على الأفعال التي تضر الطفل أو تعرض سلامته للخطر.
و من هذه الجرائم ترك الطفل أو تعريضه للخطر و هي الصورة الأولى لهذا الفعل، و تكمن الصورة الثانية في تحريض الأبوين على التخلي عن طفلهما.
Abstract EN
The national legislature cared, as the rest of the legislations, for the child protection.
He included the protection of children's rights in the Constitution of 1996, and embodied it in a constitutional amendment in 2016.
Penal Code also has included this protection by approving special provisions penalizing acts that harm the child's safety or exposed him to danger.
Among these crimes: abandon the child or exposing him to risk which constitute the first form of this act, and the second form resides in the incitation of both parents to abandon their child.

Le législateur national a donné une importance, comme dans le reste des législations, à la protection de l’enfant.
Il a inclut la protection des droits de l'enfant dans la Constitution de 1996, et son incorporation dans un amendement constitutionnel en 2016.
Le code pénal a également inclut cette protection en approuvant les dispositions spéciales qui pénalisent les actes qui nuisent à la sécurité de l'enfant ou l’expose au danger.
Parmi ces crimes : abandonner un enfant ou le laisser exposé au risque qui constitue une première forme de cet acte, et une deuxième forme réside dans l'incitation des deux parents à abandonner leur enfant.
