Juvenile penal law is a law of cautionary measures; penalty is the last resort and exception, wherefore the idea of ‘penalizing’ delinquent children should be abandoned forever, because juvenile criminal justice aims to provide, the best for the child, without sacrificing the interests of society and justice.

In many judicial systems, mediation as a restorative justice programs have first been developed for children induced to crime, then formed the basis for programs created for adults.

Therefore, the fundamental priority of Penal mediation, in terms of the Child Protection Law, are the children induced to crime, as a very necessary alternative to the criminal justice system (Alternative Dispute Resolution) today, because it can resolve conflicts that still exist between the parties, so expected to reduce the accumulation of the case, is one of the dispute resolution process that is considered to be faster, cheaper and simpler, can provide the widest possible access to the parties to the conflict to obtain justice.

Penal mediation, which is an alternative means of dispute resolution in terms of the Child Protection Law, that process has potential benefits for all sectors of society, to prevent, manage or resolve a conflict by helping the parties to develop mutually acceptable agreements.

Results of mediation can provide access to justice for the child, victims and the community and is an instrument of restorative justice.

La médiation pénale présente un avantage incontestable, par rapport aux procédures juridictionnelles, car le processus de médiation permet de rendre aux parties le pouvoir de gérer leur conflit, pour que la solution du conflit soit négociée, plus qu'imposée.

De ce fait, Elle est considérée comme une alternative aux poursuites pénales, puisqu’elle poursuit certains objectifs spécifiques, tels que la prise en considération des victimes en leur donnant un rôle actif dans la gestion de leur affaire, ce qui peut leur garantir une réparation tant matérielle qu'immatérielle du dommage subi; la responsabilisation du délinquant qui va mettre un visage sur l'objet de son délit; et enfin, la reconstitution du tissu social dans la mesure où parfois la médiation, ne vise pas seulement à résoudre un litige, mais cherche bien à assurer une réconciliation.
