تخضع حالة و أهلية الجزائريين، حسب الفقرة 3 من المادة 3 من القانون المدني الفرنسي، لقانونهم الوطني.
و من خلال هذه الدراسة، سيتم إبراز تراجع العمل بالقانون الوطني لمصلحة قانون الإقامة المعتادة، و أيضا الدفع بالنظام العام لإظهار عدم فعالية الإسناد للقانون الوطني.
Abstract EN
According to the article 3, indent 3, of the French civil code, the state and the capacity of the Algerians are governed by national law.
This study shows the decline of national law to the advantage of the law of the habitual residence, then it is interested except for public order to show the ineffectivité of the unification in national law.

Selon l’article 3, alinéa 3, du code civil français, l’état et la capacité des algériens sont régis par la loi nationale.
Cette étude démontre le déclin de la loi nationale au profit de la loi de la résidence habituelle, puis elle s’intéresse à l’exception d’ordre public pour démontrer l’ineffectivité du rattachement à la loi nationale.
