Abstract AR
استكمال العقد، سلطة يخولها القانون للقاضي بتوسيع من خلالها مضمون العقد، و ذلك بإضافة التزامات لم يتفق عليها المتعاقدان بهدف تحقيق التوازن العقدي و الأمن القانوني.
و قد أظهرت التغيرات الاقتصادية و الاجتماعية أن استكمال العقد لا يتعارض و مبدأ سلطان الإرادة كما كان معتقدا في السابق و إنما يتوافق معه.
Abstract EN
The outcome of the contract is a power granted by the law to the judge to widen the contractual contents by adding obligations not suited by the contracting parties with the aim of affecting the contractual balance and the legal security.
The economic and social changes showed that the outcome of the contract is not, as we believed it formerly, against the principle of the authority of the will, but compatible with this one.

L’aboutissement du contrat est un pouvoir accordé par la loi au juge afin d’élargir le contenu contractuel en additionnant des obligations non convenues par les contractants dans le but d'atteindre l'équilibre contractuel et la sécurité juridique.
Les changements économiques et sociaux ont montré que l’aboutissement du contrat n'est pas, comme on le croyait jadis, contraire au principe de l'autorité de la volonté, mais compatible avec celui-ci.
