اعترف المشرع الجزائري للإدارة بسلطة تعديل عقودها الإدارية في إطار ما يعرف بالملحق، و ذلك من خلال التنظيم المقرر للصفقات العمومية.
و لذلك، إن موضوع الملحق في الصفقة العمومية يكتسي أهمية بالغة في الواقع العملي، حيث أنه و نظرا لما أثير من فضائح مالية لعدد هام من الجهات الإدارية و التي مرد أكثرها التجاوز الصادر من الإدارة المتعاقدة من جراء استعمالها سلطتها في تعديل صفقاتها بإبرام ملاحق تابعة لها، استوجب الأمر هنا تدخل المشرع للحد من سلطة الإدارة.
فسلطة الإدارة في تعديل عقودها الإدارية و إن كانت سلطة أصيلة توجد حتى في حالة سكوت العقد و دفاتر الشروط إلا أنها ليست مطلقة.
و عليه، قمنا بتسليط الضوء على أهم أحكام و قواعد الرقابة المقررة على آلية الملحق في الصفقة العمومية، و الذي يطرح مجموعة من التساؤلات، منها خاصة : ما هي اللجان المختصة بالرقابة على الملحق ؟ و ما هو الأثر المترتب على هذه الرقابة ؟ ما مدى فعالية سلطة الرقابة على الملحق في الصفقة العمومية و ما مدى تأثير ذلك على المتعامل المتعاقد مع الإدارة في ظل غياب نظام قانوني واضح المعالم يضبط هذه الآلية ؟
Abstract EN
The Algerian legislature accepted for administration to change its administrative contracts by the amendment, in accordance with regulations in force.
The theme of the amendment to the public procurement is of paramount importance in practice, especially after the financial scandals of a large number of administrations, most are due to overruns issued by the Contracting Authority after the use of its power to amend its markets by concluding additional agreements related to these.
In this case it became necessary here; legislative intervention to end to limit the authority of government; because despite that this authority is exercised by the same administration when it is not provided for in the specifications and initial markets; but it is not absolute.
The theme of endorsement, which we chose, presents a set of problems we will try to answer through this article that can be summarized in the following question: What are the relevant committees of the rider control? What is the impact of the effect of this control? What is the effectiveness of the control authority of the riders to public procurement ?

Le législateur algérien reconnait, en vertu de la réglementation en vigueur, à l’administration la prérogative de modifier ses contrats administratifs par le biais de l’avenant, lequel renferme en matière des marchés publics une importance capitale dans la pratique, et ce, après les scandales financiers d’un nombre important des administrations.
Ces scandales sont dus souvent aux dépassements commis par l’administration contractante à la suite de l’utilisation de son pouvoir de modifier ses marchés par la conclusion des avenants.
D’où, l’importance de l’intervention du législateur afin non pas de mettre un terme auxdits dépassements, néanmoins de limiter le pouvoir exorbitant de l’administration à cet égard, encore que ce pouvoir peut être exercé par l’administration même s’il ne figure pas dans le cahier de charge, mais non pas d’une façon absolue.
En réalité, le mécanisme d’avenant aux marchés publics pose un ensemble de questions: Quelles sont les commissions compétentes du contrôle d’avenant? Quelle est l’impact de l’effet de ce contrôle? Qu’elle est l’efficacité de l’autorité du contrôle des avenants aux marchés publics?
