The subject of the research focuses on the legal and judicial mechanisms available in Algerian legislation, in order to preserve the rationality in the conclusion of the topic of public transactions, before their conclusion and in advance.
In order to guarantee the impartiality of the public administration, as well as the misuse of power, the legislator embodied this action in the Algerian Code of Civil and Administrative Procedure 08-09, which, like other judicial orders, is characterized by objective and formal conditions
