After the international community realized the need to judge and punish the international crimes perpetrators especially after the first world war, and starting to search in the bases of the international criminal responsibility and develop them to application, in order to get response from the responsible persons about the international crimes perpetrators for the law requirements should be a criminal punishment that cannot be dropped it only by specialized judicial authority, that has start by establishing international military court Nuremburg, Tokyo and the international criminal court.

As this subject is related about using the untraditional weapons and for that we started to study the concept of the untraditional weapons with all its types and risks that represented by the nuclear, chemical and biological weapons that contain the enriched uranium by considering it chemical radiological and toxic weapons.

And this study deal also shows the ability to use the untraditional weapons as crime that related to the international criminal court crimes as genocide, humanity crimes and the war crimes and to display the punishments for these crimes that represented by the freedom punishments and the financial punishments in addition to the other punishments according to the basic regulation of the international criminal court.
