Abstract EN

The research paper comes in the form of practising and training to download the jurisprudence approaches to scientifie investigations .Thus, the general jurisprudence approaches in the sciences of “Hadith” are substantiated and accepted in scientific investigations, as they achieve a number of cognitive complementarities between the jurisprudence and “Hadith” science.

In which, we have raised the ancient and the modern controversy because it is a rich source for many “Hadith” studies and jurisprudential ones.

The appearance that appears to the viewer in the books of “Hadith” and jurisprudence in which they have written and spoke about different and contradictory narratives in the matter of admitting acceptance of transmission from the first and the second generations .

Some of them believe that it is achieved by sticking to the texts of “Al Hadith “ savants and to the criticizers ,some of them state that the occurrence is the best reason , some of them obey and follow the consensus and accept it despite the proven aversion and infidelity of transmission since the first era , some of them control the acceptance from the death of : Othman ,may Allah be pleased with him ,some of them hint at the fact that : Eschafii was the first to protest against the transmitted “Hadith” but we find that a lot of savants dennied him and his point of view and the proportion which beared a lot of words and speeches , some of them didn’t differentiate between the two periods or ears mentioned before, and some of them put the “Hadith” on the stage of research and into texts neglecting how it comes or from where it comes , saying that it is the separator and ruler in terms of acceptance or response.

However satisfactory face in all those, was that the first era was acceptable, but not in general, in second era, the protest was in most periods .This rejection and acceptance remain general and full The transmitted Hadith was based on pillars and precise, clear considerations that are the question of agreement and disagreement We have conducted our research as follow : The first two studies were issued with texts on the acceptance and response of the first and the second periods followed by a third one, which contained the jurisprudence approach on the texts dealt or spoken about.
