Abstract EN

The Algerian legislator’s approval of the principle of penal responsability for legal entities in the penal code when amended in 2004 has required him to establish special procedural rules with regard to its follow up and trial in accordance with its nature, including the matter of the legal entity’s representation who is penally followed up before the penal court, which was discucced in the penal procedure code when amended in 2004,too.

Special texts were created in this latter to show how to represent the legal entity who is penally followed up.

And the problem raised from this study’s subject is to examine whether the texts contained in the Algerian law are enough to deal with any possible problems that may arise; concerning his representation during the course of the proceedings against him? Therefore, this essay discusses legal entity’s representation issue in the case where he is penally followed up alone without his legal representative, in the case where his legal representative is followed up with him and the legal entity’s representative situation during the proceedings.
