Abstract EN

The principle of legality is a fundamental guarantee for the protection of individual rights and freedoms from arbitrary management and authoritarianism in the event they carry out their various activities under normal circumstances.

However, there are some constraints that would limit it, allowing the administration greater scope to derogate from it in exceptional circumstances, which may threaten their existence.

So, they cannot deal with these extraordinary circumstances through normal legal rules that requires the expansion of their powers to meet these conditions to match them through recourse to special legislation such as the state of emergency and Affect and restrict a large part of individual rights and personal freedoms that are constitutionally dedicated to the asset.

The question in this regard is the statement of the position of the Jordanian and Omani legislations regarding the state of emergency and their impact on individual rights and freedoms
