Abstract EN

This research deals with the procedures of division of real estate which has no title, where dealing with real estate which has no title is one of the most complex issues faced by practitioners.

Through this research, I have clarified that the only way to divide real estate which has no title is by a judicial only, because the judiciary can verify ownership by various ways.

Property is a material fact that can be proved by various ways, especially if the source of ownership is inheritance or statute of limitations.

That is the Supreme Court says in several of its decisions.

After making decision of division by judiciary.

The judgment must be deposited at administration of tax to register and then a deposited it in administration of land registry as long as the real estate does not have a title, the judgment dividing the real estate which has no title cannot deposit it at the administration of land registry .

so the beneficiary of the judgment dividing a real estate which has no title .he should follow the procedures of real estate investigation for depositing his judgment at the administration of land registry.
